Hawaii Process Serving Laws & Rules
Understanding Hawaii's rules for service of process helps ensure your documents are served properly and your case proceeds without delays. Below are answers to the most common questions we receive.
Can You Serve Papers on Sunday in Hawaii?
Yes. Unlike some mainland states, Hawaii law does not prohibit service of process on Sundays or holidays. Service can be made any day of the week, making it easier to reach defendants who work Monday through Friday.
Our process servers are available 7 days a week, including Sundays and holidays, to accommodate urgent legal deadlines.
What Are the Legal Service Hours in Hawaii?
In Hawaii, service of process is generally permitted between 6:00 AM and 10:00 PM. While service outside these hours is not automatically invalid, it may be subject to challenge in court.
For the strongest legal standing, we recommend and conduct service within these hours. Early morning and evening attempts are often most successful for serving individuals at their residence.
How Long Does Process Service Take in Maui?
Service timing depends on the location and availability of the person being served:
- Central Maui (Kahului, Wailuku): Often same-day or next-day
- South Maui (Kihei, Wailea): 1-2 business days
- West Maui (Lahaina, Ka'anapali): 1-2 business days
- Upcountry (Makawao, Kula): 1-2 business days
- East Maui (Hana): 2-3 business days
Rush and same-day service is available for urgent matters. Call (808) 747-4238 for immediate dispatch.
What If Someone Is Avoiding Service in Maui?
If a defendant is actively evading service, Hawaii law provides alternatives:
- Substitute Service: After reasonable attempts at personal service, documents may be left with a person of suitable age and discretion at the defendant's residence or workplace
- Service by Publication: For defendants who cannot be located, the court may authorize service by publication in a newspaper
- Skip Tracing: We offer skip tracing services to locate defendants who have moved or are hiding
We document all service attempts with GPS coordinates, timestamps, and detailed notes to support any motion for alternative service.
What Is Required for Valid Service in Hawaii?
Under the Hawaii Rules of Civil Procedure (HRCP Rule 4), valid service typically requires:
- Personal delivery to the individual named in the documents
- Service by a person who is at least 18 years old and not a party to the case
- A completed proof of service (affidavit) filed with the court
Our process servers are trained in Hawaii service requirements and provide court-ready affidavits with every completed serve.
Can I Serve Papers Myself in Hawaii?
No. Under HRCP Rule 4(c), service must be made by a person who is not a party to the action. You cannot serve papers in your own case. A professional process server, sheriff, or any adult non-party may serve documents.
Using a professional process server ensures proper documentation and eliminates any conflict of interest questions.
